The "Regulations on Promoting the Development of the Lithium Battery Industry in Zaozhuang City" (hereinafter referred to as the "Regulations") were passed at the 13th meeting of the Standing Committee of the 17th People's Congress of Zaozhuang City on June 29 and approved at the 4th meeting of the Standing Committee of the 14th People's Congress of Shandong Province on July 26. They will come into effect on October 1 of this year.

 

This regulation is the first special regulation for the lithium battery industry in China and the first industry promotion regulation formulated by Zaozhuang City.

 

The promulgation of the "Regulations" marks the legalization of the lithium battery industry in Zaozhuang City, and has significant practical and profound historical significance in leading and promoting the high-speed and high-quality development of the lithium battery industry and building the lithium battery capital in the north.

 

The Standing Committee of the People's Congress of Zaozhuang City organized and carried out legislation to promote the development of the lithium battery industry, focusing on promoting "strong industry and industry development, transformation and breakthrough". During the legislative process, opinions and suggestions from various sectors of society are widely solicited through various forms such as newspapers, websites, legislative public opinion express trains, grassroots legislative research, online and offline entrepreneur forums, etc. A total of over 2000 opinions and suggestions were collected, and over 500 were absorbed and adopted, making legislation more in line with public opinion, gathering people's wisdom, and benefiting people's livelihoods, and practicing people's democracy throughout the legislative process.

The Regulations fully reflect the characteristics and innovation of the development of Zaozhuang lithium battery industry. Firstly, we will focus on promoting the development and growth of the lithium battery industry chain. Clarified the establishment and improvement of a mechanism for the integration and linkage of chain leaders, chain owners, and alliances, through government enterprise linkage, multi-party joint efforts to supplement, extend, and strengthen the chain; The second is to focus on solving the problems of the Zaozhuang lithium battery industry's weak magnetic attraction effect on high-level talents, insufficient reserve of industrial workers, and serious faults. It has stipulated the establishment and improvement of a new model of enclave research and development, the establishment of lithium battery related majors in local higher education institutions, the application for professional title evaluation of lithium battery characteristic majors, and support for entrepreneurship and innovation of scientific researchers; The third is to focus on building a highland for lithium battery product inspection and testing.

 

According to the Regulations, lithium battery enterprises are encouraged to carry out lithium battery product inspection and certification platform construction, support the National Lithium Battery Product Quality Inspection and Testing Center to upgrade testing equipment, expand testing projects and service scope, and reduce testing and certification costs; Fourthly, we will focus on optimizing the legal environment. Explore the establishment of a lithium battery court, promote the intensification of handling cases involving the lithium battery industry, professionalization of trials, and precision of services, and promptly and efficiently resolve conflicts and disputes. Fifth, we will focus on addressing the financial support issues that are of common concern to lithium power industry enterprises.

Chapter 1 General Provisions

 

Article 1: In order to promote the high-quality development of the lithium battery industry, cultivate and strengthen innovative lithium battery industry clusters, create the lithium battery capital in the north, and promote green and low-carbon transformation and development, in accordance with relevant laws and regulations, combined with the actual situation of this city, this regulation is formulated.

 

Article 2: These Regulations shall apply to activities related to the development and promotion of the lithium battery industry within the administrative area of this city.

The lithium battery industry referred to in these regulations refers to the research and development, design, production, inspection and testing, sales, terminal application, recycling, and production of lithium battery raw materials and supporting components.

 

Article 3: The development of the lithium battery industry follows the principles of policy guidance, innovation driven, industrial synergy, and cluster development.

 

Article 4: The municipal and district (city) people's governments shall strengthen their organizational leadership in promoting the development of the lithium battery industry, incorporate the development of the lithium battery industry into national economic and social development plans, formulate and supervise the implementation of policies for promoting the development of the lithium battery industry, establish a coordination mechanism for the development of the lithium battery industry, and study and solve major problems in the development of the lithium battery industry.

The energy department is the competent department for the development of the lithium battery industry, responsible for planning, coordinating, and organizing the promotion of the lithium battery industry development.

Development and reform, science and technology, industry and information technology, finance, human resources and social security, natural resources and planning, ecological environment, housing and urban-rural construction, commerce, administrative approval services, market supervision and management, local financial supervision and management, taxation, power supply and other related departments shall do a good job in promoting the development of the lithium battery industry within their respective responsibilities.

 

Article 5: The municipal and district (city) people's governments shall coordinate industrial development funds and provide support for scientific and technological research and development, industrial guidance, technological transformation, talent recruitment, cooperation and exchange in the lithium battery industry.

 

Chapter 2 Planning and Development

 

Article 6: The Municipal People's Government shall strengthen the planning and guidance of the lithium battery industry, adhere to the full chain coverage, regional layout, and full cycle services, and promote the formation of a coordinated development pattern of the lithium battery industry with different characteristics, complementary advantages, and reasonable structure.

 

Article 7: The municipal energy department shall, in conjunction with relevant departments, formulate a development plan for the lithium battery industry, and submit it to the municipal people's government for approval before making it public to the public.

The district (city) people's government shall formulate specific implementation plans based on the development plan of the lithium battery industry and in combination with the actual situation.

 

Article 8: Establish and improve a mechanism for the integration and linkage of chain leaders, chain owners, and alliances. The chain leader of the lithium battery industry chain is responsible for coordinating the overall development of the lithium battery industry, coordinating and solving major issues in the development of the lithium battery industry, and promoting the supplementation, extension, and strengthening of the industry chain. The industry chain leader is generally led by industry leading enterprises, leading and driving the collaborative development of upstream and downstream enterprises in the industry chain. Promote the formation of industrial alliances among backbone enterprises, universities, research institutions, or other organizations in the lithium battery industry, strengthen enterprise coordination and industrial integration, leverage agglomeration effects, and build an industrial community with resource sharing, complementary advantages, and win-win cooperation.

 

Article 9: The Municipal People's Government shall establish a lithium battery industry development strategy consulting expert committee composed of experts from higher education institutions, scientific research institutions, enterprises, industry associations, and relevant parties, to provide consulting opinions for the formulation of lithium battery industry development plans, policy measures, key technology research, and major project promotion.

 

Article 10: The municipal energy department shall, in accordance with the development plan of the lithium battery industry, formulate a guide catalog and a graph of the lithium battery industry chain to promote the optimization and upgrading of the industrial structure.

The Municipal Department of Commerce should establish a customer and project database in conjunction with the Municipal Development and Reform, Municipal Energy and other departments, targeting key areas and missing links in the industrial chain to attract upstream and downstream supporting affiliated enterprises in the lithium battery industry to settle down, and consolidate and enhance the advantages of the entire industrial chain.

The municipal statistics department should strengthen the statistical investigation and monitoring analysis of the lithium battery industry, and provide statistical data based on the list of lithium battery enterprises provided by the municipal energy department.

The municipal market supervision and management department should actively cultivate collective trademarks, guide lithium battery enterprises to carry out trademark brand construction, and support lithium battery enterprises to participate in the formulation of national and local standards for the lithium battery industry.

The municipal industry and information technology department should actively cultivate national level specialized, refined, and new "little giant" enterprises for lithium batteries, provincial specialized, refined, and new small and medium-sized enterprises, and single champion manufacturers in the manufacturing industry, establish a digital empowerment promotion mechanism, support lithium battery enterprises to increase their technological transformation efforts, and promote the integrated development of digitization, intelligence, and networking.

 

Article 11: Encourage lithium battery enterprises to establish off-site resource bases through resource exploration cooperation, equity acquisition, long-term agreements, etc., to provide resource support for the long-term development of the lithium battery industry.

 

Article 12: The municipal and district (city) people's governments shall strengthen scientific layout and support the orderly development of charging and swapping infrastructure and network construction by utilizing existing parking lots, ports and docks, gas stations, and newly built residential areas. Support the promotion and application of lithium battery products in cultural tourism, public transportation, freight, logistics, environmental sanitation and other fields.

 

Article 13: Support the comprehensive utilization of waste lithium batteries and green and environmentally friendly dismantling and recycling, encourage the construction of centralized collection and storage centers for waste lithium batteries, and create a lithium battery recycling industry base.

 

Article 14: Support the National Lithium Battery Product Quality Inspection and Testing Center to upgrade testing equipment, expand testing projects and service scope, reduce testing and certification costs, and create a highland for lithium battery product inspection and testing.

Encourage lithium battery enterprises to carry out lithium battery product inspection, testing, and certification platform construction.

 

Article 15: Encourage lithium battery enterprises in the city to strengthen supply and demand cooperation, reduce transportation costs, and promote coordinated development of the upstream and downstream of the industrial chain.

 

Chapter 3 Scientific Research Innovation

 

Article 16: The Municipal People's Government shall establish and improve a lithium battery technology and industry innovation system, cultivate and apply for a batch of high-level innovation platforms around lithium battery research and development and manufacturing, waste battery recycling, etc., promote efficient integration of entrepreneurial and innovative resources, promote breakthroughs in key core technologies, and accelerate the development of the lithium battery industry.

 

Article 17: Support large enterprises and small and medium-sized enterprises in the upstream and downstream of the industrial chain to form innovation consortia, carry out research and development of common industrial technologies and key core technologies, and build an industrial ecosystem of collaborative innovation, resource sharing, and integrated development.

 

Article 18: Relying on the Shandong Lithium Battery Industry Innovation and Entrepreneurship Community Platform to carry out industrial common technology research, systematically promote core tasks such as achievement transformation, enterprise incubation, listing cultivation, public platform construction, and talent introduction and cultivation.

 

Article 19: Establish and improve a new model of enclave research and development. Support enterprises to carry out research and development innovation outside of the city through various methods such as independent construction, joint research and development, and school enterprise co construction. Utilize the advantages of high-end talents from outside the city to form research and development achievements and achieve the transformation of scientific and technological achievements in the city.

 

Article 20: Promote the development of lithium battery basic education and applied vocational skills education, and establish lithium battery related majors in higher education institutions such as Zaozhuang College and Zaozhuang Vocational (Technician) College. Establish a school enterprise joint mechanism to cultivate lithium battery professionals through various means.

 

Article 21: Encourage universities, research institutions, enterprises, industry associations, and other organizations to carry out long-term and interdisciplinary basic research on the lithium battery industry, and undertake and participate in major national, provincial, and municipal science and technology projects.

Support researchers from universities and research institutions to start their own businesses or work part-time in enterprises in accordance with relevant regulations, and engage in the transformation of scientific and technological achievements in the lithium battery industry.

 

Article 22: Give full play to the demonstration and leading role of the energy storage base in Zaozhuang City, support lithium battery production enterprises to improve their research and development production capacity of energy storage batteries, and accelerate the development of energy storage projects.

 

Chapter 4 Service Guarantee

 

Article 23: The municipal and district (city) people's governments shall establish a service mechanism for the agglomeration and development of the lithium battery industry, promptly solve the difficulties and problems in the development of the lithium battery industry in terms of funds, land, talent, technology, data, etc., and provide a good development environment for the lithium battery industry.

 

Article 24: The relevant departments of the municipal and district (city) people's governments shall optimize their supervision methods, implement supervision and inspection based on the principle of no disturbance or investigation, improve law enforcement efficiency, and reduce the impact on the normal production and operation activities of enterprises.

 

Article 25: The municipal development and reform department shall deepen the full lifecycle management services for key projects in the lithium battery industry, improve mechanisms such as leadership assistance, specialist promotion, and joint meetings, and actively promote the inclusion of lithium battery projects in the list of provincial-level key projects.

 

Article 26: Departments such as finance, commerce, taxation, and customs shall, in accordance with their respective responsibilities, promptly guide and assist lithium battery enterprises in enjoying tax and fee preferential policies in accordance with the law, and encourage lithium battery enterprises to actively carry out import and export trade activities.

 

Article 27: The city and district (city) shall formulate preferential policies for talent introduction and regularly carry out special recruitment activities. Support lithium battery enterprises to introduce high-level talents, teams and innovation and entrepreneurship projects in a variety of ways, help solve the problems of registered residence, medical care, education, housing and immigration of high-level talents, and provide convenience in project application, scientific research activities, etc.

 

Article 28: The municipal human resources and social security departments shall apply to the provincial human resources and social security department for the evaluation of lithium battery characteristic professional titles based on the development needs of lithium battery enterprises and the characteristics of professional and technical talent positions.

Trade union organizations should actively guide lithium battery enterprises in creating innovative studios for model workers and craftsmen, and provide policy and financial support.

 

Article 29: Strengthen the protection of intellectual property rights in the lithium battery industry and its key technological links. Improve the reporting and complaint system for intellectual property infringement, and investigate and punish illegal acts that infringe on the intellectual property rights of lithium battery enterprises in accordance with the law.

 

Article 30: Provide support for the lithium battery industry in terms of planning space and planning indicators for new construction land, to ensure the reasonable land use needs for the development of the lithium battery industry. We will adopt various flexible land supply methods such as flexible annual transfer, leasing before leasing, combination of leasing and leasing, and long-term leasing to ensure the supply of land for the lithium battery industry.

 

Article 31: Support lithium battery enterprises in building new energy power generation projects, promote the implementation of policies such as green power trading, promote demand side management of electricity, and reduce the energy consumption costs of lithium battery enterprises.

The management agencies and other units of the lithium battery industry park should coordinate and improve the construction of infrastructure such as pipeline networks, strengthen cooperation with natural gas supply enterprises and steam supply enterprises, and reduce production costs for enterprises.

 

Article 32: Development and reform departments shall coordinate energy consumption indicators to provide guarantees for key construction projects in the lithium battery industry chain.

The ecological environment department should explore the implementation of pilot projects for paid use and trading of pollution discharge rights, and expand the sources of pollution discharge indicators for the construction of lithium battery industry projects.

 

Article 33: The municipal, district (city) people's governments and relevant departments shall establish and improve credit incentive mechanisms for lithium battery enterprises, and use measures such as risk compensation, rewards, credit enhancement, and interest discounts to guide financial institutions and local financial organizations to provide diversified and differentiated financing services for lithium battery enterprises and reduce financing costs through innovative financial products, providing preferential interest rates, and reducing guarantee rates.

Encourage financial institutions to provide guaranteed financing for lithium battery enterprises with rights such as accounts receivable, intellectual property, orders, warehouse receipts, inventory, machinery and equipment, or movable property as collateral. Encourage the development of supply chain finance and support financial institutions to provide financing services for upstream and downstream lithium battery enterprises based on the credit and transaction information of core supply chain enterprises.

 

Article 34: In accordance with the principles of government guidance, professional management, urban linkage, and healthy development, promote the standardized and efficient operation of the Zaozhuang New Energy Industry Guidance Fund, and focus on investing in core enterprises and high-quality projects in the lithium battery industry.

Encourage each district (city) to establish lithium battery industry guidance funds and establish a three-dimensional fund allocation system that combines local industry advantages and resource endowments. Utilize the role of fund attraction to attract upstream and downstream enterprise headquarters, production bases, research and development centers, etc. to settle in Zaozhuang, promoting the agglomeration and development of the lithium battery industry.

Departments such as finance and local financial supervision and management are exploring the establishment of a collaborative mechanism between financial institutions, social capital, and the lithium battery industry guidance fund.

 

Article 35 Local financial supervision and regulation, finance and other departments shall actively support and guide the listing of lithium battery enterprises, and encourage the introduction of lithium battery listed companies from outside the city to relocate and settle in this city.

 

Article 36: Explore the establishment of a lithium battery court, promote the intensification of handling cases involving the lithium battery industry, professionalization of trials, and precision of services, and promptly and efficiently resolve conflicts and disputes.

 

Article 37: Establish and improve organizations in the lithium battery industry, and encourage them to provide services such as entrepreneurship cultivation and guidance, intellectual property protection, investment and financing, technology research and development, and talent cultivation.

 

Article 38: Encourage the holding of exhibitions, competitions, forums, academic exchanges and other activities in the lithium battery industry in this city, support enterprises to participate in international exhibitions and industrial cooperation, and promote the demonstration and application of lithium battery related products at home and abroad.

 

Article 39 The people's government and its relevant departments shall implement policies regarding the lithium battery industry funding subsidies, project approval, and talent treatment enjoyed by enterprises, universities, research institutions, other social organizations, and individuals in accordance with relevant regulations.

If the implementation is not implemented or delayed, the parties involved have the right to complain to the relevant units. The handling unit shall communicate and contact the parties involved within one working day, and complete the procedures within five working days; For particularly complex cases, an extension of fifteen days may be granted with the approval of the responsible person of the undertaking unit. If there are other provisions in laws and regulations regarding the processing time limit, such provisions shall prevail.

 

Article 40: Public officials who abuse their power, neglect their duties, or engage in favoritism and fraud in promoting the development of the lithium battery industry shall be punished in accordance with the law; If a crime is constituted, criminal responsibility shall be pursued in accordance with the law.

 

Chapter 5 Supplementary Provisions

 

Article 41: The municipal people's government shall formulate supporting measures to promote the development of the lithium battery industry in accordance with these regulations.

 

Article 42: These regulations shall come into effect from October 1, 2023.
